Abstract

One of phenomenon that occurs in Indonesia is interfaith marriage. This marriage was carried out partially openly and partially carried out secretly. Islam forbids interfaith marriages based on the word of Allah Surat al-Baqarah verse 221. Interfaith marriage is also issued by Law No. 1 of 1974 Article 2. The main problem in this study is health issues and how the laws of marriage are interfaith according to the jurists. This research is library research. Sources of data in this study include: Al-Quran and alhadith, fuqaha opinion, Law No. 1 of 1974 concerning marriage, and Compilation of Islamic Law. To review this problem used library research (library research) and analytical analytic research. Article 2 paragraph (1) Law No. 1 of 1974 concerning Marriage ("Law 1/1974") states that marriage is legal, carried out based on the law of each religion and its beliefs. Article 10 PP No. 9 In 1975 it was declared a new marriage legally made in the presence of the recording employee and attended by two witnesses. And the procedure for marriage is carried out according to the laws of each religion and its beliefs. So, Law 1/1974 does not recognize interfaith marriage, so interfaith marriage cannot be done. Article 40 of KHI states the prohibition on marriage between a man and a woman who is not Muslim. Fuqaha denies the marriage of Muslim women with non-Muslim women either ahlul kitab or musyrik.
